Hey guys earlier i poste a thread sayin i was tradin my rhino but it was runnin right..well now i have a new problem..i live up in a small mountain town so i never really worried about the title to the rhino..well i bought it used from a guy in colorado springs..i thought i had gotten the title from him but today i went to go get it changed to my name here in new mexico and they denied me..it turns out it is the Certificate of Origin..plus i also gave me a bill of sale..he never got a title for it..so wouldnt u guys think since he signed the Certificate of Origin plus the bill of sale i should be able to just get a title in my name??? i mean theres never been a title so why cant i be the first one to get one?? but instead they are tellin me to track this guy down and send him the Certificate and have him get a title and the sign it over and send it to me..but the problem is i cant even find the guy..he lived 6 hours away from me and i guess he moved..I dont know what to do!!! i cant even sell or trade this thing..HELP!! thanks

I never had an issue with a certificate of origin. For me it's as good as a titile. My Rhino only had a certificate. The new owner took the certificate, bill of sale and registered it. I never bothered though. I consider the certificate a negotiable document.

yeah but the only thing is that the certificate is originally under the guys name that i bought it from..he signed it and gave me a billl of sale..but here in new mexico the law is that any atv or ruv has to have a title and a license plate...so i dont know im confused..i dont know what to do

I had the same problem,went to buy a bike from a guy all he had was a certificate of origin, my banker said that does not show ownership made me run the guy down and he had to title it before i could borrow the money to buy it. hope you figure out what else you can do

i dont know what to do..i looked for this guy all over the place on the white pages in colorado..and nothing..this sucks..i wouldnt even be able to give this thing away

it should be easy to sell(maybe besides in nm) id buy an atv,utv with the paperwork that you have!! how much you want for it!!j/k........ i think you have to pay taxes if you buy it out of state before you recieve a title!! i know alot of people who go out of state to avoid taxes therefore they dont have a title!! or thats the way they do here!!

Yup same here when going out of state unless you come back to where you live and pay the taxes you cant get the title.

many states dont do titles on off road vehicles, georgia does not, mso is all that you get.

i dont think that would work because then they do a VIN check and they will find out there has never even been a title for it..i dont see why this guy wont just trade for it just with the MSO and bill of sale

ive been using the internet to track him down..the thing is, is that there is ALOT of people with his name..i dont know where to start..im hoping i could just sell it to someone with the paperwork that i have..thanks for all the help

The certificate should have the name of the place he purchased it from and maybe they will have a phone number on him. Good luck.

yeah TRIED THAT lol..the place is in louisiana and the only phone number they had was from when he lived in louisiana and then he moved to Colorado(the place i got it from) and then i guess he moved again..i just wanna sell this thing and get it over with

I'm with most of the guys above. I've bought new and used atvs and utvs for a long time with never anything more than you've got and never had a single problem. I guess it all just depends on your state laws. Good luck.

I just went through this ,well sort of. I bought a teryx in Sealy Texas, using a bank in Vidalia La. Texas does not require UTV's to be titled. All I recieved from the dealer was an MSO. I have had the Teryx now for like 6 months. The banker called to ask wherwe the title was. I called the dealer and they told me Texas law. I made a copy of the law off the net, and mailed a copy of it to the bank with a copy of my MSO, and where I paid texas sales tax on the bike. No more worries. Is your bill of Sale notarized? If so, write or call the DOT or whatever licensing Bureau you have there and explain to them, you have a legal Bill of sale and a signed MSO. then call the dealer where the other guy bought the bike, and ask if he paid sales tax. If he did, they should be able to provide you with a copy of the sales form for him, showing where he paid La state tax. Then mail of go to your local office with this paperwork and they should be able to title it in your name. I traded an 08 Big Bear I bought in Mississippi on my Teryx. It had never been titled either. The dealership sold it with no issues whatso ever. Now grnated it was traded and resold in Texas, and Texas does require titling of ATV's just not UTV's. Don't ask me why, its just the way it is. Anyway, you have a legal document as long as you can prove taxes were paid on the bike, and that the vin can be matched on all the paperwork.

well thats another problem..the bill of sale isnt notarized..it was just signed by me..and the seller..and a witness..and my local MVD office told me to send it back to him and get it notarized..the problem is i still cant find him...but the vin does match the MSO and the Bill of sale and he signed the back part of the MSO..but still it wasnt notarized

ya a guy called me today wanting to buy it..i explained what happend and he said he knows a guy that works for the main DMV office in Santa Fe..he said he'll c what he can do and call me back..im actually waitin 4 him to call me..hope he calls back

In Texas you could provide a notarized "Affidavit of Fact" with the MSO, bill of sale, etc. If you have independent "title transfer agencies" in your state I would try them first. They seem to be more willing to get things done then the local County tax offices are.

Exapmle:

Affidavit of Fact

I _name and address exactly as shown on the other documents___, hereby certify and swear under oath that I that I am the rightful and legal owner of ___description___, VIN# ________________.

___signature__ ___notary____

thanks man..ok now that its gettin sold im gona buy me a truck..im workin and ill make plenty of money guideing elk hunters this fall and winter so now the question is whats gonna be my next sidexside?? i LOVED my rhino..never had any problems..it went where i wanted it to...but id lm really startin to look at the 09 ranger HD..those things are NICE..im gonna stick to sidexsides though..love them..but now i need to think of my next one.i should be able to get a new one by january

ya thats the only thing i dont like about the rangers..theyre huge!! but other than that the new 09s look awesome!! but im really also lookin at the new 09 rhino thats like a dark red color..that thing is nice too!! right now its either a rhino or ranger...decisions decisions...
