I was driving east on 84 about two miles east of Brookhaven in the pouring rain. I was reading the HL forums not really paying attention to the speed limit. Out of nowhere it seemed I had blue lights flashing in my rearview. Mississippi State Trooper. I pulled over, he got out walked up to my window, told me he clocked me 70 in a 55. I handed him my license, he walked back to his car and came back a few minutes later and handed me a ticket and told me to call the number on the bottom before September 19th. He got back in his car and left. I read the ticket and he wrote me for going 70 in a 50! I turned around to see if I could find him and ask him why he wrote 50 instead of 55. I saw a trooper car in the median, pulled up beside him but it was a different trooper. I said, I thought this is a 55 mph zone? He said it is a 55 mph zone. I said then why did the other guy write me for speeding in a 50 mph zone? He just kinda shrugged his shoulders. I told him that the other guy was just trying to get more money out of me. He told me not to worry about it that the court would straighten it out. I told him I wasn't going to court that I was just going to pay the ticket. He just sat there with a dumb founded look on his face. I ask him where the other guy went that I wanted to get this straightened out right now. He finally picked up his cell phone and acted like he was going to call him. He said he would get him on the phone and get it taken care of. All that was last week. I called the number on the bottom of the ticket this morning and he did infact change it at the court house to 55. The court date is set for september 19th. Anybody think I could beat this ticket if I were to show up in court and plead not guilty to 70 in a 50?

you could try it. But what if they ask you why you were going 70 in a 55? then you will have to pay the fine AND the court cost...no good!

YOu can beat it. What kind of radar? Radar dosent work correctly in the pouring rain. The rain will give you a false reading. It is indicated on the citation that it was raining?
I have to agree with GWC though. Raining, reading and speeding when you are supposed to be driving.

I think it depends on what section of the forum you were reading when you got pulled over as to whether or not you can beat it.  Remind me to stay off of 84 if I ever drive through Mississippi.  As far as the ticket goes I would just defer it if that is an option in MS.  I think it would be a long shot to beat it.  I've never heard of radars not working in the pouring rain.  Is that why you don't see many cops giving tickets in the rain?  I always assumed it was because they didn't want to get wet.

About the only way you are going to get out of a ticket is if the trooper doesn't show up. As far as the radar not working right, Maybe years ago but the newer radar unit are self-calibrating and oblivious to weather. Not to mention the fact that if you tell the judge that you were speeding 70 in a 55 that is an admission of guilt. There is not alot to fight there.

if the trooper has already amended the ticket in court, than it is just like he gave u the ticket for 70 n 55..the weather does not affect the calibration of the radars...if anything the ONLY problem weather will affect is maybe with range or how sensative the radar is...which is kinda the same as range...if he clocked u 70 n 55...than u were doing 70 n 55..rain has nothing to do with it...same as texastrailrider said, years ago they had problems with interference, but now they have filters in the radars that compensate for that..most lawyers want try a radar case, unless there is gross negligence on the troopers side..which there's not..most of the time u can go to the DA's office and talk to them...depending on your driving record they will help u out all they can....good luck

anybody ever heard of clerical error? I got one dropped for the same reason he wrote the wrong limit on my ticket. Yue judge threw it out said if the trooper didn't know what the speed limit was how was I supposed to know.

Even if its raining and the radar does not work correctly, state troopers are trained for this. Depending were you are they can look at you and tell you how fast you are moving by using light poles, trees, etc. But if you go to court and plead not quilty on 50-70 you will get out of it becouse thats what the tickit states. Well you were in a 55 mph zone in the ticket says 50. You need to take pictures too have proof. MPH sign, mile markers, anything that can help you out.

The bottom line in all this is 70 in a 55 in the rain while trying to read a forum board is the things that keep careflight in business. I have seen some accidents that were caused by less that stick in your head for weeks.

Judge: Why are we in here today, sir?

    SK: Because I wasn't going 70 in a 50.  The posted limit was 55.

Judge: Speeding is speeding, son. Ill reduce your fine $20, you are to pay fine plus court costs of $20. Now slow down out there before you hurt yourself or someone else.

    LOL, j/k

You had a better chance if you didnt get them to change the clerical error .... either way if you go in front of the judge you have a very limited chance of getting off scott free. You can be issued a ticket for doing the speed limit when it's "pouring" as you are drive at a speed unsafe for road conditions. You planned on just paying the ticket ... why change your plans?

in our court system, if the trooper amended the ticket prior to the court date, it does not matter what your copy of the ticket says...as long as the court copy of the ticket is right that is all the judge cares about...Scooped_Kawasaki stated that the trooper did infact change it at the court house...there is nothing he can do...if i was the trooper i would have wrote the ticket for speed and c&r (careless & wreckless) driving...hahaha......agian this is how our court system works....

If you were that unaware of your surroundings (reading HL forums while operating a vehicle in the rain no less) as to not notice the trooper until he was on your bumper you deserve the ticket and count your lucky stars no one got hurt from your negligence. Not to be harsh but pay attention to what you are doing, especially on the freeways where someone besides you can be affected by your carelessness.

i got a speeding ticket in mississippi one time by a trooper also. but the trooper said i was going 74 in a 55 with a truck loaded and a trailor with a golf cart.  But im sorry if i was going 74 with all that my truck would be swaying side to side.  But in all i just paid it. way cheaper then i thought 130.00 for out of state.  everytime i get a ticket its for 19 over the speed limit when i was going faster. so i cant complain

Ok, Ok, Ok. I get the point. I was careless for reading, speeding and not paying attention sheesh. But it was a pretty funny post. And to all of you who say I was reckless, you are correct 100%. I didn't think this post would stir folks up so much. What I was really trying to point out is the trooper wrote the wrong posted limit down in an attempt to get more money from me. He knew it was 55 and wrote 50. That was what I was trying to get across. Does anyone remember the Louisiana State Police and the 20/20 investigation between Baton Rouge and Lafayette?

NAH WHAT HAPPENED WITH THAT, id like to hear about it becuz i drive that a few times a year

last time i had  a run in with the state troopers he busted me for window tint being to dark, well heck i knew it was to dark lol, but i played it off like i just brought it in to a place and said tint my windows, funnier thing was he pulled me over in my own driveway roflmao, well i drove in the driveway and i was already pulled in the back where i park, then he pulled in and hit his lights roflmao

needless to say my fronts were to dark and my 2 back doors were too dark as well, he didnt say nothing about my back glass which was the same as the two back doors becuz the back glass doesnt matter, anyhow he gave me 72 hours to take the tint off and bring it up to the state trooper place and get them to check it out, so i took it off and went to show them i took it off and i walked in and the guy just said "ah yes, well sir did you take the tint off", i told him yes i did, would you like to check it out, then he said "ill take ur word for it"

i was like well crap if i wouldnt of taken it off and went in there u woulda ended up checking it

oh well state popo's do a pretty good job around here so i cant complain to much
